I. General notes and commitments
1. Price transparency
All prices displayed include applicable taxes. Shipping fees, when applicable, are clearly indicated before payment is confirmed.
2. Sustainable practices
Our growing practices aim to limit pesticide use and promote responsible and sustainable methods.
3. Duty to assist
We assist customers in selecting plants suitable for their climate, environment, and growing conditions. However, the final responsibility for plant care, maintenance, and adaptation remains with the customer.
II. Legal warranty (Consumer Protection Act – Québec)
4. Legal conformity
In accordance with sections 37 and 38 of the Québec Consumer Protection Act, goods must be fit for their normal intended use.
Live products:
The legal warranty applies only to hidden defects that were not apparent at the time of delivery.
The warranty does not cover damage related to:
- watering or maintenance practices,
- climatic or environmental conditions,
- transport after delivery,
- improper handling or acclimation.
III. Inspection and claims
5. Claim period
Any non-conformity, error, or damage must be reported within 48 hours of receiving the order.
6. Proof of defect or damage
The customer must provide clear and dated evidence, such as:
- photos or videos,
- a detailed description of the issue,
- any other relevant supporting documentation.
Les Serres Tropico-Québec reserves the right to conduct its own evaluation before making any decision.
IV. Delivery and transfer of risk
7. Delivery
Delivery times are provided as estimates only. Delays caused by weather, carriers, or circumstances beyond our control do not engage our liability.
8. Transfer of risk
Risk associated with the products remains with the seller until the order is physically handed over to the customer or their designated representative.
V. Returns, storage, and unclaimed orders
9. Live products – no returns
Live plants are non-returnable and non-exchangeable, except in the event of an error on our part or a confirmed hidden defect.
10. Pickup orders (on-site collection)
The customer must collect their order by the agreed date (“pickup deadline”).
Grace period:
- 2 weeks at no charge.
Storage fees:
- 5% of the order total or $10 per week (whichever amount is higher).
Termination:
After a total of 8 weeks without pickup, the order will be considered abandoned. The business reserves the right to retain the products and applicable fees, including a penalty of up to 20% of the amount paid.
By completing an order, the customer acknowledges having read, understood, and accepted these Terms and Conditions of Sale in full.
